Minister Marianela Cifuentes, presiding over extraordinary hearings for human rights violations at the San Miguel Court of Appeals, has convicted former DINA agent Miguel Krassnoff Martchenko for his role in the aggravated kidnapping of a woman, committed starting on October 4, 1974.

In the ruling (case role 7-2020), the minister sentenced the then-Captain of the Chilean Army to an effective prison term of 6 years as the author of the crime.

On the civil side, the court ordered the state to pay 100 million pesos in moral damages to the victim, as noted in the judicial bulletin.

In her ruling, Minister Cifuentes established the following facts:

«1° On October 4, 1974, around noon, agents from the National Intelligence Directorate (DINA) unlawfully detained (…) at the property located at Ravel Passage No. 262 in San Bernardo.

2° Subsequently, (…) she was taken to the DINA’s clandestine detention center known as ‘Ollagüe,’ located on José Domingo Cañas street in Ñuñoa, where she was held illegally and interrogated about her spouse’s activities and whereabouts (…), a member of the Revolutionary Left Movement (MIR), through illicit coercion, including beatings, cigarette burns, strip searches, and electric shocks, administered by Osvaldo Romo Mena and Basclay Zapata Reyes, agents of the Halcón team.

3° Later, she was moved to another clandestine detention center of the DINA, called ‘Cuatro Álamos,’ and subsequently to the ‘Tres Álamos’ detainee camp, from where she was expelled from the country on May 17, 1975.

4° At the time of the events, the National Intelligence Directorate was tasked with conducting operational and repressive actions aimed at persecuting individuals with political views opposed to the regime established in Chile beginning on September 11, 1973, focusing particularly on dismantling the Revolutionary Left Movement (MIR) through the systematic use of illegal coercion and enforced disappearances.

5° The National Intelligence Directorate, under the command of Army Colonel Juan Manuel Guillermo Contreras Sepúlveda, had an Intelligence Brigade responsible for the operational units of this organization, commanded by Army Lieutenant Colonel César Manríquez Bravo.

6° Several operational brigades and the clandestine detention centers known as ‘Ollagüe’ and ‘Cuatro Álamos’ depended on the mentioned Intelligence Brigade, headed by Marcelo Luis Manuel Moren Brito and Orlando José Manzo Durán, respectively.

7° The Caupolicán Brigade had various operational teams, including Halcón, led by Captain of the Army Miguel Krassnoff Martchenko, whose primary function at that time was to dismantle the Revolutionary Left Movement (MIR).

8° In this context, (…) she was detained and later interrogated by agents of the aforementioned operational team to obtain information about her spouse’s whereabouts, a MIR member,» the investigation concludes.
