The Chile Sustainable Foundation has released an analysis of the key administrative, legislative, and institutional environmental decisions made by the Executive during the first 100 days of President José A. Kast’s administration.
The report highlights one significant event: the withdrawal, on March 12, of 43 environmental decrees that were pending review by the General Comptroller of the Republic.
These include, importantly, air quality standards, emission regulations, decontamination plans, guidelines for implementing the Biodiversity and Protected Areas Service (SBAP), various instruments linked to the Framework Law on Climate Change, and a number of decrees for the creation and recognition of protected areas.
Chile Sustainable emphasizes that these decisions create «regulatory uncertainty and hinder the implementation of public policies developed through extensive technical processes across several administrations, with contributions from specialists, public agencies, business associations, and civil society organizations during both formulation and public consultations.»
«The blocking of these standards impedes the gradual improvement of the environmental institutional framework recommended even by the OECD, and affects the current operational capabilities related to decontamination, biodiversity protection, and compliance with commitments established by the Framework Law on Climate Change, as well as other international obligations in these areas,» the Foundation pointed out.
The evaluation also assessed the legislative agenda promoted by the Executive, including initiatives aimed at modifying the Environmental Impact Assessment System, restricting access to environmental justice, and delaying the implementation of the SBAP.
Additionally, it reviewed the new Energy Route 2026-2030 and decisions made by the Ministry of the Environment to eliminate the office responsible for implementing the Strategy for a Just Socio-Ecological Transition.
In this regard, they noted that «the 100-day period allows us to identify the direction of the new government’s environmental management. A general analysis of the Executive’s actions shows a pathway of stagnation and delays in regulations needed to address pollution, the climate crisis, and biodiversity loss, alongside a general relaxation of environmental assessments.»
Given all of the above, Chile Sustainable called on the government «to guarantee the continuity and full implementation of state policies on environmental matters, and to protect existing mechanisms for citizen participation and access to environmental justice.»
Moreover, they demanded «not to destroy what has been built in environmental matters over the last 30 years of democratic governance and to clarify the principles behind this ongoing Environmental Deconstruction.»
