The extraordinary visiting minister for human rights violations at the Appeals Court of San Miguel, Marianela Cifuentes, has filed charges against retired Army officer Luis Rodrigo Albornoz Costa for his involvement in the aggravated kidnapping of Luis René Lobos Gutiérrez (25) and Carlos German Maldonado Torres (41), which took place starting on October 21, 1973, in the municipality of Maipú.
In her resolution (case number 33-2012), the visiting minister accused Albornoz Costa, who was a second lieutenant at the time of the incidents, as the perpetrator of the crime.
During the investigative stage of the case, the magistrate gathered sufficient evidence to establish the following facts:
“1st That on September 11, 1973, soldiers from the Reinforced Mountain Infantry Regiment No. 18 ‘Guardia Vieja’ from the city of Los Andes, commanded by Lieutenant Colonel Luis Víctor José Prussing Schwartz, were deployed to the municipality of Maipú, taking positions within the premises of the Santiago International Fair (FISA) and the Carabinero police station in Padre Hurtado, where a control post was established.
2nd That the military contingent stationed at the Carabinero police station in Padre Hurtado was placed under the command of Army Sub-Lieutenant Luis Rodrigo Albornoz Costa.
3rd That on October 21, 1973, around 9:00 PM, while Sergio Raúl Carvajal Arrieta was inside a truck with Fanny Rosa Arenas Ramírez, he was threatened with a firearm by Juan de Dios Leyton Contreras, a Corporal of the Chilean Air Force, who was accompanied by Luis René Lobos Gutiérrez and Carlos German Maldonado Torres, all of whom were intoxicated.
4th That moments later, Sergio Carvajal Arrieta, accompanied by Carlos Víctor Diethelm Ulbrich and Ernesto de la Fuente Gandarillas, reported the incident to military personnel stationed at the previously mentioned Carabinero police station in Padre Hurtado.
5th That around 10:00 PM, at the ‘La Estrella’ restaurant located in Santa Ana de Chena, municipality of Maipú, Luis René Lobos Gutiérrez, Carlos German Maldonado Torres, and Juan de Dios Leyton Contreras were detained by military personnel from the aforementioned control post, including Rubén Santiago Pinilla Riquelme – now deceased – who subsequently transported them to the Carabinero police station’s facilities in vehicles belonging to Carlos Víctor Diethelm Ulbrich and Ernesto de la Fuente Gandarillas.
6th That later, Juan Leyton Contreras, due to his position as a member of the Chilean Air Force, was taken to the military barracks set up at FISA in Ernesto de la Fuente Gandarillas’s vehicle, while civilians Luis René Lobos Gutiérrez and Carlos German Maldonado Torres were taken to the Carabinero post in Malloco.
7th That the detained Luis René Lobos Gutiérrez and Carlos German Maldonado Torres were not received at the aforementioned police unit, remaining under the custody of soldiers from the control post installed at the Carabinero police station in Padre Hurtado, as previously noted, under the command of Sub-Lieutenant Luis Rodrigo Albornoz Costa, their whereabouts have been unknown since then.
