Futaleufú Case (Los Lagos Region): Controller Warns of Risks in Land Purchases by Dual Nationals

The Los Lagos Regional Controller has raised alarms regarding land acquisitions in the border area of Futaleufú. This came after an investigation into two public deeds signed in 2016 by the companies Inversiones Talavera Limitada and Inversiones Rumbo Sur SpA, detailing the purchase of 448 hectares in the Lago Lonconao sector without disclosing the nationalities of the company’s members.

According to the Ministry of National Assets, national interest strictly prohibits citizens of neighboring countries from acquiring ownership or rights to real estate located wholly or partially in Chile’s border zones. This prohibition extends to companies based in those neighboring countries, or those where 40% or more of the capital is owned by nationals from those countries, or where control is held by their citizens.

Despite this, the legal representative of the mentioned company swore that the society did not belong to citizens from countries bordering Chile, even though the Internal Revenue Service indicates that 32% of the ownership corresponds to Argentine citizens.

While this percentage does not violate the law, the Controller’s office believes this declaration may constitute a crime, prompting them to refer the case to the Public Prosecutor’s Office.

Dual Nationality

A copy of the report has also been forwarded to the ministries of the Interior, Foreign Relations, National Defense, and National Assets, as well as to the Directorate of Borders and State Limits, so they can implement the necessary controls to ensure compliance with these rules.

This is particularly concerning due to the risks associated with dual nationals acquiring border land while simultaneously holding citizenship from a neighboring country, thereby violating regulations.
