The Constitutional Court (TC) has approved the removal request submitted by Socialist Party deputy Juan Santana against Johannes Kaiser due to his endorsement of the coup d’état in Chile.
It is important to recall that the libertarian leader was asked, «If the same circumstances as in 1973 occurred, would you support another coup d’état?» To this question, and with no room for ambiguity, the deputy responded directly and unequivocally: «Without a doubt, absolutely.»
Notably, the statements made by then-deputy Johannes Kaiser on July 3, 2025, constitute grounds for his dismissal from parliamentary office, specifically as outlined in Article 60, paragraph five, concerning the encouragement of altering the constitutional legal order through means other than those specified in the Constitution, which requires a legal pronouncement from this esteemed Constitutional Court.
Ultimately, what is at stake in this action before the Constitutional Court is not merely a violation of a legal standard, but a profound impact on the foundational principles that uphold our democratic coexistence.
