The court accepted the defense’s arguments after confirming that confinement in the REPAS jeopardizes the 68-year-old inmate.

During a judicial hearing, the Seventh Guarantee Court of Santiago upheld the defense’s action and ordered the Chilean prison service to return Mauricio Hernández Norambuena, former leader of the Manuel Rodríguez Patriotic Front (FPMR) known as «Comandante Ramiro,» to the Rancagua Penitentiary Complex within a maximum of ten days.

The court’s ruling puts a halt to the unexpected transfer executed by the penitentiary institution, which had confined the former FPMR member in the High Security Special Penitentiary (REPAS). The defense and Hernández’s supporters claimed from the very beginning that the measure lacked technical justification, constituting a strictly political punishment.

At the end of the hearing, the lawyer and nephew of the inmate, Mauricio Menares Hernández, expressed his satisfaction with a ruling he considers solid, asserting that «we are quite pleased with the court’s resolution, as it is well-founded based on the reports,» referring to those from the National Human Rights Institute and the penitentiary body itself.

The attorney emphasized that the assessments were categorical in stating that the inmate’s profile does not align with the purposes of the facility where he was held in isolation. «The REPAS does not have the criminogenic profile for individuals like Mauricio,» Menares explained, noting that this space is designed to contain organized crime or inmates who are highly resistant to traditional prison regimes.

For the defense, the ruling represents a significant milestone as it becomes the first judicial step in the fight against the arbitrary treatment suffered by Ramiro. Menares highlighted the humanitarian criteria applied by the court during the case debate, asserting that «the judge accepted our requests, particularly recognizing with intensity that Mauricio is a person, a human being, and as such, has the same rights as others.»

Despite the favorable ruling, Hernández’s legal representative warns that the process may face new administrative challenges, clarifying that Gendarmería may eventually file appeals. However, he pointed out that while technically the ruling does not allow for appeal, they will remain vigilant in case higher courts open channels for discussion with the institution.
