Coyhaique Court Confirms Precautionary Measures Over Senator Calisto’s Assets in Fiscal Fraud Case

In a ruling reinforcing the investigation into fiscal fraud, the Appeals Court of Coyhaique has denied the appeal filed by the defense of Miguel Ángel Calisto Águila, confirming precautionary measures over part of his assets. According to reports from Diario El Divisadero on April 10, 2026, the appellate court upheld the decision made by the Coyhaique Guarantee Court, which had accepted the request from the State Defense Council to secure potential civil liabilities arising from the alleged crime.

The First Chamber of the court, consisting of ministers Pedro Castro, Luis Aedo, and judicial prosecutor Jaime Álvarez, dismissed the defense’s arguments regarding lack of justification, impropriety, and disproportionality of the measures. In their ruling (case role 89-2026), the judges stated, «This Court, in a decision confirmed by the Honorable Supreme Court, established the presence of evidence with sufficient reality and plausibility for the case against the accused to be formed,» thus meeting the cautious requirement of fumus boni iuris.

The court emphasized the proportionality of the measure, stating: «Given that the fiscal damage under investigation amounts to approximately today, $103,000,000, it is sufficient to restrict the measure to assets whose valuation proportionally covers that amount».

In this regard, the magistrates determined that this aim is satisfied by the precautionary measure imposed on the property located at El Vergel Street No. 2405, apartment 804, in Providencia, and its storage unit No. 20, «thus avoiding excessive impact on the accused’s assets.»

Finally, the ruling explicitly confirmed the orders made on March 11, 2026, by the Coyhaique Guarantee Court, limiting these precautionary measures to just those two assets. The decision, reported by El Divisadero, concludes that the appeal is rejected, «with the declaration that these are limited exclusively to the property located at El Vergel Street No. 2405, apartment 804 […] and to the storage unit No. 20 assigned to it,» preserving the rest of the parliamentarian’s assets in the context of the fiscal fraud investigation.
