The push to apprehend Galvarino Apablaza reached a new episode this weekend, alongside a strong response from his defense. Lawyer Rodolfo Yanzón harshly criticized the attempt to capture him in Argentina, asserting that any ongoing actions lack legal foundation.

Apablaza Guerra will not present himself, as doing so would affirm an absolutely illegal act. Once again, we must state that the extradition process aimed at sending him to Chile was concluded 16 years ago. Consequently, anything being done is illegal,» he stated to Teletrece.

His remarks follow a failed police operation that was unable to locate the former leader of the Frente Patriótico Manuel Rodríguez (FPMR) at his home, a situation that reignited pressure from right-wing sectors to execute his transfer to Chile.

Defense Escalates the Conflict, Highlighting International Illegality

However, Yanzón did not stop there. The attorney took the conflict to an international level, claiming that the current actions violate fundamental commitments regarding asylum.

«It becomes significantly more illegal if we consider that the validity of asylum is still being discussed, meaning that what they are doing is once again violating the Refugee Convention. We will report this to the United Nations within the next few hours,» he warned to the aforementioned media.

Additionally, he criticized the arrest warrant issued by Judge María Servini, pointing out that it was issued without in-depth knowledge of the case. He expressed hope for the return of the presiding judge, Ariel Lijo, to nullify the detention order signed by a judge who utterly lacks understanding of the case and has merely signed that order and nothing more.

A Case Intertwined with History, Politics, and Asylum

The name Galvarino Apablaza repeatedly returns to the center of the political debate. A former member of the FPMR, he is wanted in Chile for his alleged involvement in the assassination of Senator Jaime Guzmán in 1991, a founder of the UDI and a key figure during Augusto Pinochet’s dictatorship.

Apablaza has been living in Argentina since 1993. After years in hiding, he was arrested in 2004 amidst a process in which the Argentine Supreme Court approved his extradition. However, in 2010 the National Refugee Commission granted him political asylum, a status that remains at the heart of the current dispute.

Contradictory Statements and Political Tension

Last week, government spokesperson Mara Sedini stirred controversy by asserting that Apablaza was convicted for Guzmán’s murder, a statement she later had to retract. His defense questioned her remarks, using them to underline doubts about the guarantees of a potential trial in Chile.

«The statements made by that lady (Sedini) confirm once again that Chile does not have the institutional conditions for Apablaza Guerra to undergo due process,» Yanzón asserted.

For now, the offensive that some factions had begun to promote as a show of authority has become entangled in another realm: that of the alleged illegality, ongoing asylum disputes, and questions regarding due process. When a politically motivated operation is scrutinized for its legal basis, it erodes not only the strategy but also the narrative sustaining it.
