Deputy Cuello Challenges Wealth Tax Law, Claims it Undermines Integrity and Favors Kast’s Ministers

Deputy Luis Cuello (PC), a member of the Chamber’s Labor Committee, has filed a constitutional reserve against the tax reform proposed by President Kast’s government, alleging that certain aspects of the initiative undermine the principle of integrity in public service by providing direct financial benefits to state ministers.

The constitutional reserve is based on a violation of Article 8 of the Constitution, which upholds the principle of integrity in public functions. Cuello highlighted that several cabinet ministers own high-value companies and would directly benefit financially from the contested provisions.

Cuello further elaborated on his criticisms, indicating that the project not only favors large economic groups but also government authorities through multiple clauses in the initiative, including tax rebates, reductions in corporate tax, and exemptions.

«It is quite clear that this wealth tax bill presented by the government not only benefits the friends of the administration but directly and financially benefits several of its ministers: Minister Barros, Minister Pérez Mackenna, Minister Quiroz, and Minister Daniel Mas,» the parliamentarian specified.

He added, «These ministers hold substantial assets, own publicly declared businesses, and we have requested information about these properties. Therefore, this clearly infringes a constitutional principle that is enshrined in Article 8 of the Constitution regarding integrity.»

Moreover, Cuello warned that this situation corrupts the project from the outset and opens the door for its challenge before the Constitutional Court.

«Ultimately, what this project does, through this avenue, is completely taint the initiative and render it unconstitutional. That is why we have proposed this reserve, to bring the matter before the Constitutional Court, as it is a serious issue and sets a concerning precedent,» stated the PC legislator.

In this context, he warned, «This is the first time a law, a legislative proposal, has been introduced that directly benefits ministers. This is akin to a legal self-pardon or a self-indulgence. Thus, it is quite serious from the perspective of integrity.»

Economic Impact

Lastly, Cuello reinforced his concerns by recalling the economic impact of the measures promoted by Kast’s government.

«A report from the Nodo 21 Foundation indicates that the wealth increase of state ministers and high-ranking officials could reach nearly 300 billion pesos. We are discussing a quite scandalous situation, especially when people are facing rising fuel prices, UF, and food costs. They are making sacrifices to benefit the wealth of ministers, and that seems very serious to me,» concluded the deputy.
