Judge Daniel Urrutia Laubreaux, president of the Workers’ Justice Organization (OTJ) in the Metropolitan Region, has reported the Santiago Court of Appeals to the Inter-American Court of Human Rights (IACHR), claiming he is facing administrative reprisals for attending the international tribunal. The Inter-American Court confirmed receipt of the materials and mandated that the State of Chile, via the Ministry of Foreign Affairs, provide a response within two months. The court also acknowledged a document dated May 29, 2026—officially submitted on June 1—reporting «new facts concerning an administrative investigatory process» against the judge, as detailed by ElPeriodista.cl.
Urrutia’s defense appealed to the IACHR to explicitly recognize that his appearance before the tribunal in January 2020 constitutes an act protected by Article 53 of its regulations, which prohibits States from retaliating against victims, witnesses, experts, representatives, or legal advisors due to their involvement in proceedings before the court.
Article 53 establishes that «States shall not prosecute alleged victims, witnesses, and experts, nor their representatives or legal advisors, or retaliate against them or their relatives due to their statements, opinions, or legal defense before the Court.» Additionally, the judge’s legal team requested a supervisory hearing on compliance with international obligations assumed by Chile in this case.
