Opposition Lawmakers File Criminal Complaint Over Potential Intelligence Law Violation Following U.S. Ambassador’s Statements

Deputy Luis Cuello (PC), along with deputies Juan Santana (PS) and Daniela Serrano (PC), have lodged a criminal complaint with the Public Prosecutor’s Office to investigate potential breaches involving the disclosure of classified information from Chile’s State Intelligence System to the United States.

This action comes in response to statements made by U.S. Ambassador in Chile, Brandon Judd, who claimed that his country possesses a specific analysis on the 2019 social unrest, noting that the information derives from both U.S. and Chilean intelligence sources.

The complaint requests an investigation into a potential violation of Articles 38 and 44 of Law 19,974, which establish the secret nature of the State Intelligence System’s information and penalize unauthorized disclosure or sharing.

In this context, Deputy Luis Cuello stated: «The ambassador is accustomed to intervening and commenting on internal politics. Today, he went even further by suggesting a fabricated narrative to stigmatize the left. This situation is quite serious, as it indicates that there may be illegal intelligence activities conducted by the United States in Chile. Furthermore, he clearly stated that the source of information lies within Chilean intelligence, including police agencies and the intelligence community.

«There is a crime here, and that is why we have submitted a complaint to the National Prosecutor regarding this offense defined in the Intelligence Law, seeking clarification from the U.S. Embassy on who provided the information. It is imperative that the criminal investigation examines this offense, as well as any illegal intelligence or espionage activities.»

Deputy Juan Santana added: «We want to understand the motivation behind this transmission, who facilitated it, and who authorized it. Especially in a context where our country’s sovereignty is at stake, we have seen a foreign president questioning our recent history, along with conflicts where our nation’s sovereignty and autonomy are more crucial than ever.»

Aligned with this, Deputy Daniela Serrano emphasized: «What we are safeguarding is our sovereignty. This stands in stark contrast to the government, which has not formally protested against the ambassador but only seeks background information, thereby treating this like a normal issue. Such details cannot be disclosed.

We have an ambassador who dares to interfere in national politics, particularly within our internal affairs. What we seek to clarify is whether this information transmission occurred or not; otherwise, we have an ambassador who is clearly misleading the public and is attempting to entangle himself in our international politics.»
