Original article: 2° Tribunal Ambiental emite orden de arresto contra representantes de Inversiones Lampa por incumplir medidas de protección en humedal Puente Negro
The Second Environmental Court has issued an arrest warrant for representatives of Inversiones Lampa due to repeated violations of protective measures for the Puente Negro wetland. These measures were established during the trial and in the ruling that condemned them for environmental damage in the Lampa commune, located in the Metropolitan Region.
The Court has informed that the arrest warrant has been forwarded to the Investigative Police, «with authority for search, entry, house search, and forced entry if necessary, and must inform this Court immediately after executing the arrest warrant, either to report that the individuals have been found, transported to a facility of the Chilean Gendarmerie, and the arrest has been carried out, or to report that they have not been found».
In December 2024, the Second Environmental Court condemned Inversiones Lampa to repair the damage caused to the Puente Negro wetland, which is the unique habitat of the Becacina Pintada, a bird species currently threatened with extinction.
«During the handling of this case, this court decreed various precautionary measures for the protection of the wetland, including an absolute stop to the works, the removal of machinery and workers, and the prohibition of entry of machinery, workers, and other materials to the property where the ‘Loteo Inversiones Lampa SpA’ project was being developed. These measures were reaffirmed in the ruling that condemned the company and its representatives,» explained officials from the Second Environmental Court.
The basis for ordering such measures, they added, «was aimed at preventing harm to the environment and containing or avoiding the extension of that harm already generated due to the construction and activities of the real estate project undertaken by the defendants, which by the time of the final ruling, had affected an estimated area of 40 hectares of the Puente Negro wetland».
However, despite the resolutions being firm and finalized—including a declaration of inadmissibility of an appeal for cassation by the Supreme Court—the Court could confirm, through a report from the Agricultural and Livestock Service (SAG), that urbanization activities have continued.
«When comparing the drone flyover conducted by SAG on January 14, 2026, with the information available in the case file, the Court verified that the evidence presented by the State Defense Council indeed reports on the construction of buildings and urbanization works in stage 3 of the subdivision, which as of October and November 2023, only had the demarcation of lots and work on layout paths, but no constructions had occurred,» stated the Environmental Court.
For this reason, it was determined that the defendants have violated the precautionary measures ordered by the Court, «as they continued with the execution of works and activities of the real estate project within the property, despite the existence of an absolute stop order and removal of machinery and workers, as well as prohibition of materials and tools entry to the site».

Finally, it was reported that the details of this case have already been referred to the Public Ministry for investigation into the potential commission of the offense of contempt or other environmental crimes.
