Deputy Marcos Barraza (PC) described the vandalism and incivility registry proposed by the government of José A. Kast as a «damaging project.»
According to the parliamentarian, the initiative «impairs proportionality in terms of punishment, undermines equality before the law as it subjects individuals who access social benefits or rights to double penalties, and clearly harms social reintegration and re-inclusion policies when an offense or crime occurs.»
He warned that the bill generalizes criminal behavior with minor offenses, noting that it has a pernicious tendency to punish social manifestations.
«This is clearly counterproductive concerning the exercise of democracy and has collateral effects that are very damaging. For instance, it equates graffiti with criminal acts in situations where it is a mere infraction or penalizes individuals by cutting their housing subsidies due to minor offenses, thereby harming both the individual and their family unit. Thus, we are undoubtedly facing a highly damaging project,» emphasized the legislator.

Finally, the PC parliamentarian commented, «The reality is that people want to see an end to infractions and crimes, but it is reasonable to believe that the way to organize society and establish harmonious coexistence is through proportional sanctions, not by homogenizing infractions and crimes.»
